Terms and Conditions
1. Definitions
In this Agreement:
- "Agreement" means these Terms and Conditions, together with the Vehicle Lending Agreement, KYC Policy, Appointment Letter, and guidelines communicated through the App.
- "App" or "Platform" means the Pluto Driver mobile application operated by Pluto.
- "Aggregator Licence" means Pluto's licence under Rule 86A of the Haryana Motor Vehicles Rules, 1993, as substituted by the Haryana Motor Vehicles (Amendment) Rules, 2026 (notified May 21, 2026).
- "Appointment Letter" means the formal letter issued to You by Pluto at onboarding as required under the Occupational Safety, Health and Working Conditions Code, 2020 (OSH Code).
- "CAQM" means the Commission for Air Quality Management in NCR and Adjoining Areas.
- "Delivery Partner" / "Driver" / "You" means the individual registered on the Platform to provide Delivery Services.
- "Delivery Services" means collecting parcels or packages from designated pick-up points and delivering them to customers as assigned through the App.
- "Fleet Coach" means the Pluto-designated zone representative supporting Drivers operationally.
- "Gig" means a pre-booked delivery shift slot bookable in advance through the App.
- "IDV" means Insured Declared Value — the current market value of the Vehicle as declared for insurance purposes.
- "KYC" means Know Your Customer verification conducted at onboarding and periodically thereafter.
- "MACT" means a Motor Accident Claims Tribunal under the Motor Vehicles Act, 1988.
- "NCR Districts" means districts of Gurugram, Faridabad, Sonipat, Panipat, and other Haryana districts within the National Capital Region.
- "OSH Code" means the Occupational Safety, Health and Working Conditions Code, 2020, notified November 21, 2025.
- "PUC Certificate" means a valid Pollution Under Control certificate as required under the Motor Vehicles Act, 1988.
- "RPO" means a Reasonable Prudent Operator — a person exercising the skill, diligence, prudence, and foresight of an experienced operator complying with all applicable laws.
- "Shram Suvidha Portal" means the central government portal designated under the Social Security (Central) Rules, 2026 for registration of aggregators and gig workers.
- "Social Security Fund" means the national fund to which aggregators contribute under the Code on Social Security, 2020.
- "TDS" means Tax Deducted at Source under the Income Tax Act, 1961.
- "UAN" means Universal Account Number issued on the e-Shram portal.
- "Vehicle" means the EV or CNG vehicle assigned to You by Pluto under the Vehicle Lending Agreement, compliant with CAQM Direction No. 94 (June 3, 2025) for NCR operations.
- "Pluto" / "We" / "Us" means Unispeed Technologies Private Limited.
2. Introduction & Binding Agreement
Pluto is a delivery platform and aggregator operating in Haryana under an Aggregator Licence (Rule 86A, Haryana Motor Vehicles Rules, 1993, as amended by the Haryana Motor Vehicles (Amendment) Rules, 2026, notified May 21, 2026). This Agreement governs your engagement as a Delivery Driver including your use of the App, Platform, and any Vehicle assigned to you.
This Agreement is an electronic record under the Information Technology Act, 2000. Your acceptance by clicking 'I Accept' or by using the App creates a valid, binding agreement without requiring a physical signature. An Appointment Letter will be issued to you as required under the OSH Code, 2020.

3. Eligibility & Onboarding
3.1 Eligibility Criteria
To register as a Delivery Driver on the Pluto Driver App, you must satisfy ALL of the following:
- Be at least 18 years of age
- Have at least 2 years of active riding/driving experience
- Hold a valid Driving Licence (DL) for the vehicle category assigned, under the Motor Vehicles Act, 1988, and Haryana Motor Vehicles Rules, 1993
- Hold a valid Aadhaar Card or equivalent government-issued photo-identity document
- Hold a valid PAN Card
- Have NO pending challans on your DL or Vehicle at the time of onboarding — all outstanding challans must be cleared before you are activated on the Platform
- Have no criminal conviction for (a) DUI or drug-driving; (b) any cognizable offence under the Bharatiya Nagarik Suraksha Sanhita, 2023 involving fraud, sexual offence, use of a vehicle to commit an offence, or any crime involving property damage, theft, violence, or terror in the past 3 years
- Have access to a functioning Android smartphone compatible with the Pluto Driver App
- Successfully complete all onboarding steps including KYC, document verification, biometric face verification, medical fitness examination, and mandatory induction training
- Register on the e-Shram portal and obtain a UAN (Pluto will assist with registration)
3.2 Mandatory Documents at Onboarding
You must submit valid copies of all the following at onboarding — and keep them valid throughout your engagement:
- Aadhaar Card (original for verification)
- PAN Card
- Driving Licence (valid for the vehicle category)
- Vehicle Registration Certificate (RC) — where applicable
- Valid Vehicle Insurance Certificate (comprehensive commercial cover, including third-party liability)
- Valid Pollution Under Control (PUC) Certificate for the Vehicle
- Passport-size photographs (as required)
- Bank account details or UPI ID for payment disbursements
- e-Shram UAN (or registration on e-Shram portal)
❗ Important: Submitting false, forged, or misleading documents is a criminal offence under the Bharatiya Nyaya Sanhita, 2023. Discovery will result in immediate termination and an FIR will be filed.
3.3 KYC & Background Verification
By accepting these Terms you consent to:
- Pluto conducting police verification and background checks, directly or through authorised third-party agencies
- Verification of your documents against government databases (UIDAI / Digilocker or equivalent licensed services)
- Periodic re-verification as required by Pluto or applicable law
- Pluto retaining your KYC documents as detailed in the Privacy Policy and DPDP Rules, 2025
3.4 Medical Fitness Examination
Before onboarding, you must undergo a medical examination — including an eye check-up — at a medical institution prescribed or approved by Pluto. The cost of this examination will be communicated at onboarding. You must not operate the Vehicle if you are medically unfit to do so. Pluto may require periodic medical re-assessments, particularly following any accident or health incident.
3.5 Mandatory Induction Training
You must complete a mandatory induction training programme (minimum 30 hours) before being activated on the Platform. Training covers:
- Safe riding and road safety
- Vehicle handling, EV charging, and maintenance basics
- App navigation and order management
- Customer conduct and Pluto brand standards
- Emergency procedures, accident reporting, and Vehicle theft protocol
- KYC, data privacy, and social security basics
You agree to complete any refresher or additional training as required by Pluto or applicable law from time to time.
3.6 Biometric Face Verification
The App uses facial recognition for:
- Identity verification at onboarding
- Daily liveness check before each shift
- Periodic in-shift identity checks to prevent impersonation or account sharing

3.7 Single Account & Login Security
You may hold only one active Driver account. You must not sell, transfer, or share your account or login credentials. Any misuse of your credentials is your sole liability and may result in immediate suspension. Notify Pluto immediately if you suspect unauthorised access to your account. Pluto may monitor, log, and record calls made to or by you through the Platform for training, quality, and legal compliance purposes — you provide your consent to such monitoring by using the App.
4. Nature of Relationship & Appointment Letter
Your engagement with Pluto is that of an independent contractor / platform-based gig worker on a principal-to-principal basis. Nothing in this Agreement creates a partnership, joint venture, employment, or agency relationship.
As required under the OSH Code, 2020 (notified November 21, 2025), Pluto will issue you an Appointment Letter at onboarding setting out the key terms of your engagement. As an independent contractor:
- You are responsible for your own income tax filings and any personal insurance beyond what Pluto mandatorily provides
- Pluto does not guarantee a minimum number of assignments or earnings
- You retain the right to accept or decline assignments, subject to Gig commitments and platform guidelines
- You are not entitled to employee benefits (PF, Gratuity, ESI) unless separately mandated by applicable law
⚠ Note: Haryana has not yet enacted a state-specific gig worker law. The Code on Social Security, 2020, and Social Security (Central) Rules, 2026 apply. Pluto's social security obligations are detailed in Section 9.
5. Haryana Regulatory Compliance
5.1 Aggregator Licence (Rule 86A — Haryana Motor Vehicles (Amendment) Rules, 2026)
Pluto operates under an Aggregator Licence for delivery service provision in Haryana. You operate under this licence and must comply with all its conditions:
- Using only EV, CNG, or battery-operated vehicles in NCR Districts, as mandated by CAQM Direction No. 94 (June 3, 2025) — in force from January 1, 2026
- Maintaining all valid vehicle documents (RC, insurance, PUC, DL) at all times
- Participating in the in-App driver and customer rating mechanism required under Haryana Rules
- Complying with all directions of the Haryana Transport Commissioner and CAQM
- Cooperating with any inspection, audit, or inquiry by the Haryana Transport Department
⚠ Note: Any suspension of Pluto's Aggregator Licence by the Haryana Transport Commissioner for violations — which can attract penalties up to ₹1 crore — directly affects your ability to operate on the Platform. Your compliance with these Terms protects Pluto's licence and your livelihood.
5.2 Mandatory Insurance Under Haryana Rules
Under the Haryana Motor Vehicles (Amendment) Rules, 2026, Pluto ensures the following minimum coverage for Drivers operating company-owned Vehicles:
- Health insurance: not less than ₹5,00,000 (Five Lakh Rupees) per Driver per year, increasing annually as notified by the Haryana government
- Term insurance: not less than ₹10,00,000 (Ten Lakh Rupees) per onboarded Driver
- Third-party liability insurance covering harm to customers and the public arising from Delivery Services
Coverage conditions and exclusions:
- Coverage is void for accidents caused by DUI, deliberate acts, or violation of traffic laws
- You must not admit liability or make any payment to third parties without Pluto's written consent
- You are strongly advised to obtain additional personal accident insurance independently
- In any claim event, cooperate fully with Pluto and the insurer
5.3 EV/CNG Fleet Mandate (CAQM Direction No. 94, June 2025)
All Vehicles assigned by Pluto for NCR District operations are EV or CNG compliant. You must not operate any non-compliant vehicle for Delivery Services in NCR Districts of Haryana. This mandate has been in force since January 1, 2026.
5.4 Earnings Split (Haryana Motor Vehicles (Amendment) Rules, 2026)
As mandated by law:
- Company-owned Vehicle: You receive at least 60% of the applicable delivery fee; Pluto's maximum share is 40%
- Your own vehicle (if applicable under a separate arrangement): You receive at least 80%; Pluto's maximum share is 20%
⚠ Note: These are statutory minimums. Pluto may offer better rates or bonuses at its discretion. The applicable rate is visible in the App before you accept each order.
6. Working Hours, Rest & Safety
6.1 Maximum Working Hours
In compliance with the Occupational Safety, Health and Working Conditions Code, 2020 (OSH Code, notified November 21, 2025), and Rapido-standard platform safety practice:
- You must NOT be logged into the Platform and providing Delivery Services for more than 12 hours in any calendar day
- You must take a mandatory rest break of at least 10 hours before logging back into the Platform after completing a shift
- Maximum working hours must not exceed 48 hours per week
- You are entitled to at least one weekly rest day
- A mandatory interval/break of at least 30 minutes must be taken after every 5 hours of active riding
❗ Important: Riding while fatigued is dangerous and illegal. Pluto's system will flag excessive login hours. Persistent violation of working hour limits may result in your account being temporarily locked for your own safety.
6.2 Medical Fitness During Shifts
You must not log into the Platform or operate the Vehicle if you are:
- Under the influence of alcohol, drugs, or any controlled substance — Pluto has zero tolerance for DUI
- Medically unfit to ride safely (e.g., due to illness, injury, or medication that impairs driving)
- Suffering from fatigue that impairs safe operation
Pluto may require random sobriety or fitness checks through its Fleet Coaches. Non-cooperation with such checks may result in immediate suspension.
7. Vehicle Lending, Use & Driver Liability
7.1 Vehicle Assignment
Pluto may assign you a company-owned EV or CNG Vehicle for Delivery Services. The Vehicle remains Pluto's exclusive property at all times and is not transferred or sold to you. Assignment is conditional upon successful completion of all onboarding requirements including KYC, medical fitness, induction training, and execution of the Vehicle Lending Agreement.
7.2 Authorised Use Only
The Vehicle must be used EXCLUSIVELY for Delivery Services assigned through the Pluto Driver App. You are STRICTLY PROHIBITED from:
- Using the Vehicle for personal, recreational, or any unauthorised commercial purpose
- Allowing any other person to operate, ride, or move the Vehicle under any circumstances
- Sub-letting, pledging, or mortgaging the Vehicle or offering it as security for any obligation
- Modifying, tampering, or altering the Vehicle (including bodywork, battery systems, or electronics)
- Operating the Vehicle under the influence of alcohol, drugs, or any controlled substance
- Operating outside Pluto's designated operational zones or beyond NCR/Haryana areas covered by the Aggregator Licence
- Removing, disabling, or tampering with GPS trackers, IoT devices, or telematics units installed on the Vehicle
- Carrying passengers or goods other than customer orders assigned through the App
- Accepting any booking through street hailing, WhatsApp, phone, or any means other than through the Pluto Driver App
- Carrying any illegal, prohibited, or dangerous items — you must immediately report to Pluto if any customer attempts to hand you illegal or prohibited goods for delivery
- Leaving the Vehicle unattended, unlocked, or unsecured
7.3 Standard of Care — Reasonable Prudent Operator
You agree to operate the Vehicle as an RPO: with the skill, care, diligence, and foresight of an experienced rider compliant with the Motor Vehicles Act, 1988; Central Motor Vehicles Rules, 1989; Haryana Motor Vehicles Rules, 1993 as amended; CAQM Direction No. 94 (June 2025); OSH Code, 2020; and Pluto's operational guidelines. You must always carry your DL, Vehicle RC, insurance certificate, and PUC certificate while operating the Vehicle.
7.4 Driver Liability for Vehicle Damage
- You are personally liable for all damage to the Vehicle caused by your negligence, reckless riding, traffic violations, unauthorised use, modification, or failure to care for it
- Damage assessments are conducted by Pluto's authorised service centre or an independent assessor; the report will be shared with you and you may dispute it in writing within 48 hours
- Damage costs may be deducted from your earnings (with advance notice), recovered as debt, or claimed against a security deposit
- Do not attempt repairs through any unauthorised workshop without Pluto's prior written approval
- Report any damage through the App before and after each shift — undisclosed damage discovered post-shift will be attributed to your shift
7.5 Accident Procedure & Liability
If you are involved in any accident, collision, or incident while operating the Vehicle:
- STOP immediately — do not flee the scene
- Call emergency services (112) immediately if there is injury or serious damage
- Notify Pluto through the App or helpline WITHIN 2 HOURS — failure to notify within this window may compromise insurance coverage
- DO NOT leave the scene before fulfilling your obligations under Section 134, Motor Vehicles Act, 1988 — you must provide your name, address, and vehicle details to affected persons and the police
- DO NOT admit liability, offer any compensation, or make any payment to any third party without Pluto's explicit written consent — unauthorised admissions will not be reimbursed
- File an FIR if required by law and share a copy with Pluto within 24 hours
- Cooperate fully with Haryana Police, Pluto's investigation team, any MACT proceedings, and the insurance company
- Preserve all evidence: photograph the scene, damage, third-party vehicles/property, and collect witness contact details
Liability breakdown:
- Your negligence or traffic violation: you are personally liable for all costs beyond Pluto's mandatory insurance cover, including excess/deductible, legal costs, and uninsured losses
- Third-party injury or property damage: Pluto's third-party insurance covers statutory liability; you remain personally liable for losses from wilful acts, DUI, or unauthorised use of the Vehicle
- DUI, drug impairment, or riding while medically unfit: you are fully personally liable for ALL consequences; Pluto's insurance is void in such cases; criminal prosecution under the Motor Vehicles Act, 1988 (Sections 184, 185) and Bharatiya Nyaya Sanhita, 2023 may follow; Pluto will not provide legal or financial assistance
7.6 Vehicle Theft — Procedure & Liability
If the Vehicle is stolen while in your custody:
- File an FIR at the nearest Haryana Police station WITHIN 2 HOURS of discovering the theft
- Notify Pluto through the App or helpline within 2 hours of filing the FIR; provide a copy of the FIR within 24 hours
- Provide the Vehicle's last known location, parking details, and all relevant circumstances; GPS data will also be reviewed
- Cooperate fully with the police and Pluto's internal inquiry
Liability:
- Vehicle properly secured, theft not due to your negligence, FIR filed promptly: Pluto's insurance covers the IDV claim; you are not personally liable for the IDV
- Vehicle not secured (left unlocked, running, key accessible, or parked unsafely): you are personally liable for the full IDV or replacement cost; the insurer will likely reject the claim
- FIR not filed within 2 hours or Pluto not notified in time: insurance claim is compromised; you may be held liable for the full loss
- Theft facilitated, staged, or you are complicit: you are fully liable; criminal proceedings will be initiated under the Bharatiya Nyaya Sanhita, 2023
⚠ Note: Always lock the Vehicle using all provided locking mechanisms. Park only in well-lit, secure locations. Never leave the Vehicle running or accessible to others.
7.7 Vehicle Return
- Return the Vehicle at the end of each shift to Pluto's designated hub
- Return immediately on suspension or termination of your account
- Return on Pluto's demand at any time for inspection, maintenance, or reallocation
❗ Important: Failure or refusal to return the Vehicle upon valid demand constitutes criminal misappropriation or criminal breach of trust under the Bharatiya Nyaya Sanhita, 2023. Pluto will file an FIR and seek all civil remedies including a court recovery order. Your earnings will be withheld pending Vehicle return.
7.8 Traffic Violations, Challans & PUC
- You are solely responsible for all traffic violations, challans, fines, and penalties incurred while operating the Vehicle
- You must maintain a valid, current PUC certificate for the Vehicle at all times — an expired PUC is a traffic offence
- Amounts paid by Pluto on your behalf (including e-challans under Haryana's integrated system) are recoverable from your earnings
- Report any traffic seizure of the Vehicle to Pluto within 24 hours; Pluto will provide reasonable assistance and seek reimbursement from you
8. Delivery Operations & Platform Rules
8.1 Gig Bookings & Order Acceptance
- You may pre-book Gig shift slots through the App
- Booking a Gig is a commitment. Failure to log in will impact your performance metrics and a cancellation penalty (10% of estimated shift earnings, capped at ₹100) may apply
- No penalty where non-attendance is due to a verified accident, medical emergency, or unavoidable circumstance — notify your Fleet Coach through the App as soon as possible
- Maintain a reasonable order acceptance rate as communicated by Pluto; persistently low rates affect your tier and order priority
- If an order cannot be delivered due to customer or merchant fault and you made a genuine delivery attempt, no penalty applies and you receive the applicable fee
8.2 Performance Ratings, Tiers & Algorithmic Decisions
Your performance is assessed on on-time delivery rate, customer rating, acceptance rate, and cancellation rate. These determine your tier, affecting order priority and incentive eligibility. Tier details and your score are visible in the App. If you believe a rating or tier decision is incorrect, raise a grievance under Section 10. Pluto will conduct a human review of algorithmic decisions on request within 7 business days.
8.3 Delivery Conduct
- Collect orders promptly and deliver without unwarranted delay — notify Fleet Coach or App support immediately if delayed
- NEVER tamper with, open, damage, or interfere with any customer order or package — all losses from tampering are fully recoverable from you
- Do NOT demand or collect any amount from customers beyond the delivery fee in the App — except voluntary tips, passed through to you in full
- For COD orders: collect the exact amount displayed in the App and remit to Pluto as instructed — unremitted COD amounts are a debt owed to Pluto, recoverable with interest
- Do NOT make unauthorised stops, personal detours, or non-delivery activities during an active assignment
- Do NOT carry any illegal, prohibited, or dangerous item — report immediately to Pluto and the police if a customer attempts to hand you such items
8.4 Professional Conduct & Brand Standards
- Be professional, courteous, and respectful with customers, merchants, Fleet Coaches, and the public
- Wear Pluto-branded gear or uniform as required
- Refrain from abusive, threatening, discriminatory, or harassing behaviour
- Do NOT make negative public statements (oral, written, or on social media) about Pluto, its management, or representatives
- Do NOT engage in conduct adverse to Pluto's business interests or Aggregator Licence conditions
- Remove all Pluto branding from yourself and any equipment immediately upon termination or expiry of this Agreement — continued use of Pluto branding after termination is a violation of intellectual property rights
8.5 Road Safety & Legal Compliance
- Comply with all traffic laws and road safety regulations at all times
- Wearing a helmet is mandatory — a condition of Pluto's Aggregator Licence and a legal requirement under the Motor Vehicles Act, 1988
- Using a mobile phone while riding is strictly prohibited — use only hands-free devices or stop safely before using the phone
- Pluto monitors speed and riding behaviour through Vehicle IoT systems — persistent unsafe riding results in suspension
- Do not ride to deliver faster than road conditions and legal speed limits allow — Pluto does not impose delivery deadlines that incentivise unsafe riding
- Comply with all CAQM directives applicable to NCR districts
8.6 Statutory Compliance
While delivering, you must comply with:
- Motor Vehicles Act, 1988, and Central Motor Vehicles Rules, 1989
- Haryana Motor Vehicles Rules, 1993, as amended by Haryana Motor Vehicles (Amendment) Rules, 2026 (notified May 21, 2026)
- CAQM Direction No. 94 (June 3, 2025) for NCR Districts
- Occupational Safety, Health and Working Conditions Code, 2020 (OSH Code) — notified November 21, 2025
- Carriage by Road Act, 2007, and Carriage by Road Rules, 2011
- All applicable labour, tax, and social security compliance obligations under Social Security (Central) Rules, 2026
9. Earnings, Social Security, Payments & Deductions
9.1 Earnings Structure
Your earnings may include:
- Per-delivery fee — based on distance, time, and zone, visible in the App before accepting each order
- Performance bonuses and surge incentives at Pluto's discretion
- Gig availability fee for logged-in time during booked shifts
- Customer tips — passed through to you in full
Pluto may revise the rate card with reasonable advance notice through the App. Continued use after revision = acceptance. All rates comply with the Haryana Motor Vehicles (Amendment) Rules, 2026 earnings split minimums.
9.2 Payment Disbursement
- Earnings credited to your registered bank account or UPI ID weekly (typically every Tuesday for the prior week)
- Digital payslips available in the App every payment cycle — as required under the Code on Wages, 2019, and OSH Code, 2020
- You are responsible for providing accurate bank/UPI details; Pluto is not liable for failed transfers due to errors in information you provided
- Pluto may set off amounts you owe against amounts payable to you
9.3 TDS & Tax
- You authorise Pluto to deduct TDS under the Income Tax Act, 1961, at applicable rates; TDS certificates (Form 16A) will be issued within prescribed timelines
- GST obligations from your Delivery Services are your personal responsibility
- You are solely responsible for filing income tax returns and all personal tax obligations
9.4 Social Security — Pluto's Obligations & Your Entitlements
Under the Code on Social Security, 2020, and Social Security (Central) Rules, 2026 (notified May 8, 2026):
Pluto's obligations:
- Register Pluto on the Shram Suvidha portal as an aggregator
- Register you on the portal in real time upon your engagement — you will receive your UAN
- Share your exit details in real time when your engagement ends, and quarterly engagement updates
- Contribute 1%–2% of Pluto's annual gig-related turnover (capped at 5% of total amounts paid to all Drivers) to the Social Security Fund annually
- Submit provisional social security contributions by June 30 and a final audited statement by October 31 each year
Your entitlements:
- Once engaged for at least 90 days with Pluto (or 120 days cumulatively across multiple aggregators in a financial year), you are eligible for government-notified social security benefits including accident insurance, health cover, maternity benefits, disability cover, and old-age protection
- Your UAN is portable — it moves with you if you work across multiple platforms
- Eligible Drivers may be covered under Ayushman Bharat PM-JAY for hospitalisation up to ₹5 lakh per family per year once the scheme is operationalised for platform workers — Pluto will facilitate registration
⚠ Note: Social security benefit schemes are funded by the Social Security Fund and notified progressively by the Central Government. Pluto will update you through the App as new schemes launch.
9.5 Authorised Deductions
Pluto may deduct from earnings:
- Vehicle damage or repair costs attributable to you (after the dispute process)
- Traffic challans or fines paid by Pluto on your behalf
- Gig no-show cancellation penalties
- Platform, onboarding, or training fees (as notified in the App)
- COD amounts not remitted
- Advances or loans from Pluto
- Any other amounts owed under this Agreement
⚠ Note: All deductions are itemised in your payslip. Dispute any deduction within 48 hours through 'Help & Support' in the App. Pluto will resolve deduction disputes within 7 business days.
10. Grievance Redressal
10.1 Driver Grievances
Pluto maintains a grievance mechanism for disputes over:
- Earnings deductions or payment discrepancies
- Disputed performance ratings, tier decisions, or algorithmic decisions
- Discrimination or harassment by customers, merchants, or Pluto representatives
- Disputed Vehicle damage assessments
- Unjust account suspension or termination
- Any alleged breach of this Agreement by Pluto
To raise a grievance: use 'Help & Support' in the App, contact your Fleet Coach, or write to the Grievance Officer. Pluto will acknowledge within 48 hours and resolve within 30 days.
10.2 Zero Tolerance Policy
Pluto has zero tolerance for discrimination or harassment of Drivers on any ground. Similarly, Drivers must not discriminate against or harass customers, merchants, or Pluto employees. Substantiated complaints result in immediate action against the responsible party.
11. Account Suspension & Termination
11.1 Grounds for Immediate Suspension or Termination
Pluto may suspend or terminate your account immediately for:
- Providing false, forged, or misleading documents or information at any stage
- Failure to cooperate with KYC, face verification, medical fitness, or background checks
- Unauthorised use of the Vehicle or allowing another person to operate it
- Failure or refusal to return the Vehicle upon valid demand
- Tampering with or deliberately damaging the Vehicle, IoT devices, or App
- Criminal conduct, arrest, or proceedings against you in connection with Delivery Services
- DUI or drug impairment while operating the Vehicle
- Persistent dangerous, reckless, or illegal riding behaviour
- Violation of working hour limits creating a safety risk
- Abusive, discriminatory, or threatening behaviour toward any person
- Fraud, manipulation of delivery data, fake delivery reports, or collusion
- Sharing login credentials or operating under another Driver's account
- COD misappropriation or failure to remit collected cash
- Carrying illegal or prohibited items
- Street hailing while logged into the Platform
- Breach of non-disparagement obligation
- Any other material breach of this Agreement
11.2 Termination with Notice
Where the breach does not require immediate action, Pluto will provide 14 days' written notice (through the App or in writing) during which you may make representations. Pluto will conduct a fair review before finalising. All termination procedures will comply with any statutory requirements applicable in Haryana.
11.3 Consequences of Termination
- Return the Vehicle and all Pluto-issued equipment immediately
- Remove all Pluto branding from yourself and equipment immediately
- Outstanding earnings (after lawful deductions) paid in the next payment cycle
- App access revoked immediately
- Pluto will file your exit details with the Shram Suvidha portal in real time
- Legal action for outstanding liabilities, Vehicle non-return, or any other breach
- Your data will be handled as described in the Privacy Policy
11.4 Voluntary Exit
You may exit by providing 7 days' notice through the App. All obligations — Vehicle return, outstanding amounts — must be fulfilled. Pending earnings paid in the next cycle. Pluto will report your exit to the Shram Suvidha portal.
12. Intellectual Property
Pluto and/or its licensors own all IP rights in the App, Platform, branding, and technology. No IP right is transferred to you. You may use the App only as necessary for Delivery Services. Do not reproduce, distribute, or misuse any Pluto IP. Remove all Pluto branding immediately on termination.
13. Indemnity & Limitation of Liability
13.1 Your Indemnity to Pluto
You agree to indemnify, defend, and hold harmless Pluto, its directors, employees, agents, and affiliates from all claims, liabilities, losses, damages, fines, penalties, and legal costs arising from:
- Your breach of this Agreement or violation of applicable law
- Your negligent or wrongful acts or omissions while providing Delivery Services
- Damage or injury caused to third parties or their property by your operation of the Vehicle
- Claims arising from your conduct towards customers or merchants
- Traffic violations, accidents, or criminal proceedings from your use of the Vehicle
- Loss, damage, or theft of the Vehicle due to your negligence or breach
- Any fine, penalty, or licence-affecting sanction imposed on Pluto due to your regulatory violations
- Loss or misappropriation of customer orders in your custody
- Any liability arising from illegal or prohibited items you carried knowingly
13.2 Limitation of Pluto's Liability
To the maximum extent permitted by applicable law, Pluto is not liable for:
- Indirect, incidental, punitive, or consequential damages
- Personal injury or property damage caused by your negligent operation of the Vehicle
- Loss of earnings from Platform downtime, order shortfall, or account suspension for cause
- Any loss, injury, or legal consequence from your failure to comply with traffic laws, working hour limits, or Haryana regulations
Pluto's aggregate liability to you in any calendar month shall not exceed the total earnings paid to you in that month.
14. Communications & Monitoring
By using the Pluto Driver App, you consent to Pluto and its authorised representatives communicating with you through:
- In-App push notifications
- SMS and WhatsApp messages to your registered mobile number
- Email to your registered address
- Phone calls — including calls that may be monitored or recorded for training, quality assurance, and legal compliance purposes
You agree that these communications do not constitute spam or a violation of your registration on the National Do Not Call Registry.
15. Data, Privacy & Vehicle Monitoring
By using the App, you consent to data collection and processing as detailed in the Pluto Driver App Privacy Policy (Haryana — August 2026), compliant with the DPDPA, 2023, and DPDP Rules, 2025. Key activities include real-time GPS and telematics collection, biometric face verification, KYC document retention, social security compliance data sharing, and delivery performance tracking. Vehicle IoT monitoring is continuous while the Vehicle is powered on — acknowledged as part of the Vehicle Lending Agreement.
16. Amendments
Pluto may amend this Agreement at any time. Material changes will be notified through the App at least 7 days before they take effect. Continued use after the effective date = acceptance. For law-mandated changes, notice will be as prompt as possible.
17. Governing Law & Dispute Resolution
- Governed by the laws of India and Haryana-specific regulations where applicable
- Disputes first addressed through good-faith negotiation within 30 days of written notice
- Unresolved disputes referred to binding arbitration — Arbitration and Conciliation Act, 1996; seat: Gurugram, Haryana; language: English or Hindi
- Courts at Gurugram or Chandigarh, Haryana have exclusive jurisdiction for non-arbitrable matters
- Pluto may seek urgent injunctive or interim relief from any competent court
18. General Provisions
- Severability: if any provision is unenforceable, remaining provisions continue in force
- No Waiver: Pluto's failure to enforce any right is not a waiver of that right
- Entire Agreement: supersedes all prior understandings regarding your engagement as a Delivery Driver
- Notices: delivered through the App, email, or SMS to your registered contact details
- Language: this Agreement is in English; in case of any translation, the English version prevails
